18 U.S.C. § 2257 Record-Keeping Requirements Compliance Statement

Introduction

Fancentro is a marketplace and hosting platform for creator-uploaded content. Fancentro's role with respect to that content is limited to transmitting, storing, retrieving, hosting and formatting audiovisual depictions provided by third-party content creators, together with enforcing Fancentro's terms, policies and legal compliance requirements. Fancentro is not the primary or secondary producer, as those terms are defined in 18 U.S.C. § 2257 and 28 C.F.R. Part 75, of creator-uploaded content made available on Fancentro. Fancentro does not act as the custodian of original 18 U.S.C. § 2257 performer records for creator-uploaded content.

Creator-Uploaded Content

The original records required under 18 U.S.C. § 2257 and 28 C.F.R. Part 75 for creator-uploaded content made available on Fancentro are maintained by the applicable content creator or that content creator's designated custodian of records. Requests for those records should be directed to the applicable content creator or the content creator's designated custodian of records.

Platform Compliance Requirements

Fancentro requires each content creator who uploads content to Fancentro to follow strict compliance procedures, including requirements that:

• each person appearing in uploaded content is at least eighteen (18) years of age, or the applicable age of majority in the relevant jurisdiction if higher;
• each person appearing in uploaded content has been identified and verified;
• each person appearing in uploaded content freely consented to appear in the content at the time of production and consented to the upload and publication of that content on Fancentro;
• the content creator, as the producer of the uploaded content, maintains all records required under 18 U.S.C. § 2257 and 28 C.F.R. Part 75 and agrees to provide such records promptly upon request; and
• the uploaded content complies with Fancentro's applicable Terms of Service, Child Sexual Abuse Material Policy, Non-Consensual Content Policy and all other applicable platform policies.

Other Exempt or Non-Covered Content

Some content made available on Fancentro may not be subject to the record-keeping requirements of 18 U.S.C. § 2257, 18 U.S.C. § 2257A or 28 C.F.R. Part 75 because it does not depict conduct covered by those requirements or is otherwise exempt under applicable law or regulation.
